Enduring Guardianship

What is Enduring Guardianship?

Sometimes an adult individual who is enrolled in Healthelink may not be capable of making decisions about their health care. This, however, does not mean that they can’t participate in Healthelink and receive the benefits that more information will give their health care providers.


In these situations, another person may get online access to the individual’s electronic health record, add information to their record or withdraw them from Healthelink.


To do this, the person must be a "person responsible" for making decisions on behalf of the individual. The "person responsible" includes someone who is an enduring guardian for the individual. An enduring guardian is someone who is legally recognised to make personal and lifestyle decisions for an individual who has chosen not to, or is not capable of, doing so for themself.


Enduring guardianship is different to a (enduring) power of attorney. A power of attorney relates to property and financial matters for another person. This may be accepted by Healthelink where an enduring guardianship document does not exist.

I have enduring guardianship for an individual enrolled in Healthelink. How do I get access to their electronic health record?

To apply for access to their electronic health record, you need to complete the 'Request for Associate Access to Record (for Enduring Guardians)' form. This can be downloaded using the link below, or you can call us on 1800 75 22 66 and we can mail you out a copy.

All sections of the form are to be completed by you (i.e. the enduring guardian and not the individual participating in Healthelink).


We require evidence of your identity and the individual participating in Healthelink. This should be in the form of certified photocopies. That is, the photocopies should be signed by a Justice of the Peace (JP). To find your local JP, visit: http://www.lawlink.nsw.gov.au/ and click on the ‘Justices of the Peace’ link.


We also require a certified copy of the enduring guardianship document.


Ensure that you enclose the following documents with the completed form:

  • Certified photocopies of the Healthelink record holder's identification
  • Certified photocopies of your identification (the enduring guardian)
  • A certified photocopy of the enduring guardianship document
